SB657 HFA S. Brown 2-21

 

                Delegate S. Brown moves to amend Com Sub for SB657 on page 6, Section 9, lines 133, following the period, by inserting a new subsection (o) to read follows:

                “(o) (1) The development office shall condition approval of the tourism development project or the tourism development expansion project on retaining compliance with municipal building and fire codes and zoning ordinances: Provided, That this requirement only applies to zoning ordinances that existed prior to receipt of the application by the development office.  If the development makes a finding by administrative hearing process as established by rules promulgated by the office pursuant to subsection (q) of this section, that a pattern and practice of failure to comply with municipal building and fire code and zoning ordinances has occurred at the project, the office shall condition further eligibility for the tax credit provided in subsection (d) of this section on bringing the project into future compliance, and upon failure to comply, to revoke eligibility.

                (2) The development office shall require prior to approval of the tourism development project or the tourism development expansion project that it be certified by the historic preservation director of the Department of Arts, Culture and History, as established in §29-1-8 of this code, to not have adverse impact to any historical, architectural, archaeological and cultural site of this state.
